Banta. <br />Division Director, <br />This letter is the Mined Land Reclamation Division's (MLRD) response to the <br />above-referenced Ten Day Notice (TDN1 dated November 13, 1990 and received in <br />MLRD offices November 15, 1990. The TDN involves one (1) alleged violation <br />identified during a joint inspection conducted at the Trapper Mine November <br />6 and 7, 1990. <br />Alleged Yiolation l: This involves "failure to maintain blasting records of <br />coal and overburden shots". Soecifically mentioned are "delay sketches for <br />3 years of data from date of inspection back". Colorado Regulation 4.08.5(8) <br />is listed in support of the alleged violation. <br />The regulation cited deals with the required inclusion of decking on sketches <br />of the blast patterns of shots made at the mine. The operator has Drovided <br />MLRD with evidence that sketches exist for all shots at the mine during the <br />three year period preceding the inspection. These sketches show number of <br />holes, burden, spacing, and delay patterns as well as decking, in the few <br />instances where decking was employed. <br />Asa result of the above, the Division declines to issue a violation in regard <br />to the alleged violation. There is no violation of state regulation as cited <br />in the TDN, Sketches exist for all coal and overburden shots conducted at the <br />mine far the three year period preceding the inspection date and include <br />decking, when decking was involved. <br />If you have any questions, please call. <br />Si ncerely/~ ~~n~G` <br />Dan T.
