We do not consider <br />coal fines as being a regulated discharge of fill material. However, the <br />clean up work will likely require permitting. I've included a permit <br />checklist and application, along with nationwide permit summaries for NW27 <br />and NW33. If the creation of the temporary catchment basin(s) can be <br />conducted via excavation only, i.e. without placing any material within the <br />stream or adjacent wetlands, the creation will not require permitting.
