Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 116, <br />Paragraph 4, of the Colorado Revised Statutes, that on December 13, 2006, an application to revise coal mining operations a[ <br />the Yoast Mine was considered complete for the purposes of filing. The revision was submitted by Seneca Coal Company. All <br />review and comment periods as provided in the Act and the Regulations initiate from this date of filing. <br />This technical revision provides a revised SEDCAD4 demonstration to update [he pond storage capacity for Sediment Pond <br />010. The demonstration utilizes recent landscape conditions and an annual R value that is representative of existing conditions. <br />A sensitivity analysis is used ro determine the maximum allowable sediment storage elevation, while maintaining compliance <br />with Rules 4.05.6 and 4.05.9. <br />The surface coal mining operation is on land located approximately 7 miles Southwest of Hayden, Colorado. The permit area is <br />further described as follows: <br />T6N, R87 W, Portions of Sections 28, 29 and 32 <br />TSN, R87W, All of Section l7; Portions of Sections 5, 8, I6, 18, 19, 20, 29, 30 <br />Mt. Harris &Dunckley <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Dunckley and Mount Harris. <br />The applicant is required to publish notice in a local newspaper that this application has been deemed complete. At the time of <br />publication of this notice, the applicant is additionally required to place a copy of this application at the Hayden Public Library, <br />P.O. Box 1813, Hayden, CO 8]639-1813, and at the Division office. For additional information or to provide written <br />comments, contact the Division of Reclamation, Mining and Safety, Room 215, 1313 Sherman Street, Denver, Colorado 80203, <br />(303) 866-3567. In order for us to comply with regulatory time frames, we request that comments be submitted within fifteen <br />(IS) days of this letter.
