I observed the <br />following recent mine activity that was not performed by Adience, Inc. (d/b/a BMIFrance): <br />1) continued stripping of sandstone from within the mine <br />2) substantial material was pushed from the upper ledge of the <br />mine back into the pit <br />3) the `berm" that Adience, Inc. placed at the mine to control the storm water run <br />off, was violated <br />4) slab rock on pallets had been relocated from outside of the permit area into the <br />permit azea <br />5) slab rock stockpiles outside ofthe permit azea <br />6) rock excavation activity opposed to transporting stockpiles was very apparent <br />I observed an employee of Siloam Stone at the site on Mazch 21, 1997. Ferd A. Mueller is acting <br />as the mine operator for Siloam Stone Mr. Mueller is not associated with Adience, Inc. or our <br />permit #M-77-326. We have not hired him to act as a mining subcontractor on our behalf. It is <br />our understanding that Mr. Mueller is acting as mining operator without a permit. <br />On Monday Mazch 24, 1997, in the behalf of Adience, Inc., I personally notified Ferd A.
