Box 1103 <br />Masonville CO 80549 <br />Dear Mr. Southwick: <br />In response to your letter requesting a continuance of the above item from September's Board Hearing to <br />the October 2000 meeting, the Division has decided to continue your item to the October 2000 Board <br />Hearing. , <br />To reiterate, the notice sent to you on August 3, 2000, we believe the activity may be a possible violation <br />of: C.R.S. 34-32.5-1 16(4)(1) for failure to protect areas outside the affected land from slides or damage <br />occurring during the mining operation and reclamation. Therefore, we have reason to believe that a <br />violation exists to the Law, and have scheduled this matter before the Mined Land Reclamation Board. <br />The Formal Public Hearing will be held during the October 18-I9, 2000 Board meeting for consideration of <br />the possible violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, <br />beginning at 9:00 a.m. or as soon thereafter as the matter can be considered. At that hearing you will have <br />the opportunity to be represented and heard. It will be reiterated that there is reason to believe that you are <br />in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist order, assess a Civil Penalty in <br />the amount of $100.00 to $1,000.00 for each day of violation, in accordance with C.R.S. 34-32.5-123(2) <br />and C.R.S. 34-32.5-124(7). The Board may also order the Operator to perform certain corrective actions.
