This letter is to notify you of the <br />Division's actions in regard to those ponds. <br />The configuration of ponds P-1, 2, and 7 is in congruence with the <br />approved permit. The DMG previously approved language in the <br />permit indicating Ponds P-1 and 7 had been reclaimed. Both the OSM <br />and DMG approved of the current status of reclamation of Pond P-2 <br />during the 1988 Phase I bond release. The permit also indicates <br />this pond is reclaimed. Therefore, the operator has been operating <br />in compliance with the approved mine permit, which includes <br />approval of reclamation practices which are inconsistent with <br />Colorado's regulations. <br />The Division has identified this discrepancy as a permit defect. <br />Accordingly, the operator has been notified of the requirement to <br />submit a revision within thirty days. The Division will issue a <br />decision on the proposed revision within thirty days of submittal. <br />The operator will be required to implement any approved changes <br />within twenty days of approval. A copy of the letter to the <br />operator is enclosed. Reclamation and permitting will address <br />ponds P-4, 5, and 6, in addition to ponds P-1, 2, and 7. We <br />believe this will bring the permit and the mine site into <br />conformance with regulatory requirements and will address the <br />concerns identified during the recent oversight inspection. <br />
