Cattany <br />Division Director <br />Boulder, CO 80308-2754 Natural Resource Trustee <br />Re: Cash & Who Do Mines, Permit No. M-1983-141, Receipt of 110(2) Hard Rock Reclamation Permit <br />Amendment Application Package, Revision No. AM-2 <br />Dear Mr. Collins: <br />On June 6, 2005, the Division of Minerals and Geology received your the I10(2) Hard Rock Reclamation Permit <br />Amendment Application package for the Cash & Who Do Mines, Permit No. M-1983-141. Preliminary review of the <br />information received determined that the following items must be received before the Division can consider your <br />application as being submitted and technical review can begin: <br />APP1,iCAT1nN Fl7RM~ Please complete the enclosed application form and submit the original form and one <br />copy to the Division. Submit a copy of the application with the Boulder County Clerk and Recorder with the <br />application materials already placed there and submit a receipt for filing with the Division of Minerals and <br />Geology. <br />F.XH1RiT L _ Permanent Man-Made StnECturec (Rule 63.12L• You must provide information sufficient to <br />demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected <br />land will not be adversely affected. Specifically the Xcel Energy Utility Line. <br />(a) provide a notarized agreement between the applicant and the person(s) having an interest in the <br />structure, that the applicant is to provide compensation for any damage to the structure; or <br />(b) where such an agreement can not be reached, the applicant shall provide an appropriate engineering <br />evaluation that demonstrates that such structure shall not be damaged by activities occurring at the <br />mining operation. <br />(c) Where such structure is a utility, the applicant may supply a notarized letter, on utility letterhead, <br />from the owner(s) of the utilih• that the mining and reclamation activities, as proposed, will have <br />"no negative effect' on their utility. <br />AI)i)F.NDIrM t _ Nntire Rennirementc _ Affidavit of Pncting Nntire i~nl (Role 1 62(]~(h1Y prior t0 <br />filing the application, post notices (signs) at the location of the proposed mine site, as required by the Office, of <br />sufficient size and number to clearly identify the site as the location of a proposed mining operation giving name, <br />address, and phone number of the Applicant, and stating [hat (name of Applicant) has applied for a mining <br />permit with the Colorado Mined Land Reclamation Board. Anyone wishing to comment on the application may <br />view the application at the County Clerk's or Recorder's office and should send comments prior to the end of the <br />public comment period to the Colorado Mined Land Reclamation Office, at the address given on the cover of <br />these Rules and Regulations.
