Stover and Associates, Consultant to Somerset Mining Co. <br />(SMC), dated September 30, 1993, the contents of stipulations No. 14, 16, and <br />17 were questioned. Each is addressed separately below. <br />Stipulation No. 14 <br />SMC is correct in pointing out the omitted wording in this stipulation. A <br />revised page 3 of the findings is attached and should be replaced in your <br />copies. <br />Stipulation No. 16 <br />Rule 4.10.2(2) states that, "Inspection of coal mine waste banks shall be <br />performed in accordance with Rule 4.09.1(11)". Rule 4.09.1(11)(b) requires <br />the qualified registered engineer to provide, to the Division, a certified <br />report within 2 weeks after each fill inspection. <br />Stipulation No. 17 <br />SMC has submitted the required information and addressed the revisions to <br />permit C-81-022 by submitting a complete revision (TR-17) application as <br />requested in the Division's adequacy review letter dated June 11, 1993. The <br />Division will consider the issues required by stipulation No. 17 addressed to <br />the Division's satisfaction, when TR-17 is reviewed by the Division and final <br />approval has been issued. <br />The Division has revised the wording in stipulation No. 17 to extend the <br />deadline (for resolution of the renewal issues) to January 31, 1994. SMC will <br />probably wish to request an extension for the TR-17 decision due date <br />(currently 10/15/93) in order to allow adequate time to respond to the <br />Division's adequacy review comments. <br />
