L .^ F Notice of Proposed Decision The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to Approve Bond Release Application No. 3 (SL-3) for the Roadside Portals, Permit No. C-1981-041. The mine is operated by Snowcap Coal Company, Inc. under the provisions of the Colorado Surface Coal Mining Reclamation Act of 1979. The bond release application was submitted by Snowcap Coal Company, Inc. on June 11, 2007. This application is a request for bond liability release for areas within the Roadside Portals Mine permit area that were not disturbed by mining facilities or structures. Portions of the liability release request area were undermined. No monetary release is being requested. The area for which liability release is requested includes approximately 7,294 acres within all or portions of Sections 2Q 21, 22, 23, 26, 27, 28, 29, 34, and 35 of T10S, R98W, 6th P.M.; all or portions of Sections 1, 2, 11, 12, 13, and 14 of T11S, R97W, 6th P.M.; all or portions of Sections 6, 7, and 18 of T11S, R97W, 6th P.M.; and all or portions of Section 1 of Tl S, R2E, 6th P.M. in Mesa County. The affected area is located approximately 5 miles North of Palisade, Colorado. Copies of the proposed decision are available for review at the Grand Junction Field Office of the Colorado Division of Reclamation, Mining and Safety, 101 South 3'~, Suite 301, Grand Junction, Colorado 81501, and at the Colorado Division of Reclamation, Mining and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the Mesa County Clerk and Recorder. Any person who has an interest which is or may be adversely affected may request an adjudicatory hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty (30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for the request and objections to the proposed decision.
