minor variations exist between the postmining topography as proposed in the
Permit and the existing postmining topography in parts of Pits 5 and 6.
Rockcastle will complete an engineering study identifying geotechnically and
geomorphically unstable areas of Pits 5 and 6 which do not conform to the
approved postmining topography. Based on the results of this study, Rockcastle
will implement additional reclamation measures to stabilize geotechnically or
geomorphically unstable areas of Pits 5 and 6. If additional reclamation
activities are required as a result of the engineering study of Pits 5 and 6,
and remain uncompleted at the time of final bond release pursuant to 5 V, the
cost of these uncompleted activities and associated liability will be taken into
consideration by the Division before the final bond release increment is returned
to Rockcastle pursuant to ~ V.
2. Rockcastle will reassess the geotechnical stability of the potential
slope failure area adjacent to the haul road to Pit 4. Based on this assessment
Rockcastle may s~id"!~]: implement appropriate reclamation measures to the extent
necessary to stabilize mass movement features related to the haul road to Pit
4 only in those areas that are not stable pursuant to 2 CCR 407-2 Rule 4.14.2.
w. .........:....., :.
a::::`~suz..a...'.:::e,`'ma:..:er:a:.:=S~una~ra::;:.:a :: e;'::a.::::....e::.::a;..:~::
.u.
