The <br />amount of financial warranty posted t~~ith the D'`4G shall be the difference bet~~een the <br />amount required to be posted by the DOE, and the amount required by the D\4G. In no <br />event shall the amount of financial to arranty posted with the D'`1G be less than S ] 00.00. <br />1n addition, the state reclzrnation permit application shall contain a provision that in the <br />event the DOE reduces the financial warranty, the perrnittee must post an acceptable <br />replacement ta~arranty ~~'ith the D?`1G prior to ary release by the DOE. The replacement <br />warranty shall be sufficient to cover the cost of reclamation lizbility unless the state <br />conducts an inspection and concurs with the DOE finding. <br />2) Execute a Succession of Operator and Trznsfer of Permit ("S0~'). The successor <br />applicant t~~ill need to complete an SO application (SIU0.00 zpplication fee) and submit to <br />the D;`4G a properly executed financial ~~°arramy in the amount of 510. i~0A0. The SO <br />applica;ion must be approved and the financial warranty revieā¢~~ ed and accepted by the <br />D?`4G prior to the scheduled hearins date, In the event the successor applicant wishes to <br />pursue having the D7`iG accept a DOE bond in lieu of a D'\1G bond, the successor <br />applicant twill need to provide to the D'`1G, prior to the hearing, the ttrittert verifications <br />from the DOE as described above, plus a minimum S 100.00 financial warranty to the <br />DR1G. <br />If you have any questions or need additional information, please contact me at the D:~4G's <br />Durango Field Office at 970-247->523.
