_.., -. <br /> <br />Mr. Robert H. Hagen -2- July 3, 1984 <br />The final concern raised in your letter (paragraph 1 of page 2) deals with the <br />design of the mine sewage ponds. You indicate that the pond does not meet the <br />side slope requirement of Rule 4.05.6(8)(f). This Rule pertains to embankment <br />sediment ponds. The ponds in question are not sediment ponds nor do they have <br />an embankment. They are incised sewage ponds. There is no specific rule <br />pertaining to sewage ponds in MLRB regulations. Sewage pond designs are <br />regulated by the Colorado Department of Health, Water Quality Control <br />Division. Snowmass has received approval from the Department of Health for <br />their sewage system. They are, therefore, in compliance with our requirements. <br />In summary, all ponds at the North Thompson Creek Mine area designed, <br />constructed, and certified in conformance with the Colorado Rules.
