This consideration <br />was discussed with CDMG representatives Qim Stazk, Sandy Brown, and David Berry) during a <br />conference call on May 15~ and i[ cvas agreed that final Phase III bond release and release of <br />hability for the road would be contingent on inspection of the road and conEumation that the road <br />disturbance has remained erosionally stable. The timeframe for this verification was discussed and <br />it was agreed that a period of two to three years after completion of road reclamation should be <br />adequate to evaluate erosional stabihry. <br />In summary, we regret [hat misunderstanding of prior communications with the CDMG regarding <br />use of this road resulted in issuance of the NOV. We feel, however, that resolution of the <br />associated issues through our subsequent meetings and communications and submittal of this <br />abatement package consistent with the extended abatement deadline should effectively address the <br />associated regulatory issues.
