BEFORE THE~M[NED L~D RECLAMATION BOARD STATE OF COLORADO FINDINGS OF FACT, CONCLUSIONS O__~W AND ORDER RECEIVED 141006 Divisw~~ ui nCC,dmation, Mining and Safety IN THE MATTER OF ENERGY MINERALS LAW CEN"PER'S MOTION TO INTERVENE IN THE COTTF,R CORPORATION'S APPEAL OF FINAL DETERMINATION OF DESIGNATED MINING OPERATION STATUS FOR THE JD-6, JD-8 AND JD-9 URANIUM MINES, FILE NUMBERS 1977-310, M-1984-014, M- 1977-306 ~ r1 /~ inn C ~M a ~ gyn., THIS MATTER came before the Mined Land Reclamation Board ("Board") on August 16, 2006, in Denver, Colorado for consideration of a Motion to Intervene filed by Energy Minerals Law Center and Western Mining Action Project on behalf of Colorado Environmental Coalition, San Juan Citizens Alliance, and Information Network for Responsible Mining (collectively "EMLC"). The file numbers in this matter are M-1977- 310, M-1984-014 and M-1977-306. EMLC seeks party status for the scheduled appeals by the Cotter Corporation of three Division of Reclamation, Minerals and Safety ("Division") decisions designating Cotter Corporation's underground uranium mine sites as designated mining operations or "DMOs". Jeff Pazsons and Travis Stills appeazed on behalf of EMLC. John Watson appeazed on behalf of Cotter Corporation. Russ Means and Cheryl Linden appeared on behalf of the Division. The Board, having considered the parties' presentations and having been otherwise fully informed of the facts in this matter, hereby enters the following findings of fact, conclusions of law and order: Cotter Corporation holds Section 112 reclamation permits for the JD-6, JD-8 and JD-9 uranium mines on property leased from the United States government. The JD-6 mine is 2.5 acres and is located in Section 22, Township 46 North, Range 17 West, 10th Prime M-1977-310, M-1984-014, M-1977-306 Cotter, EMLC Motion [o Intervene
