Powderhom appreciates the opportunity to <br />work with [he State and the Division of Minerals and Geology to successfully resolve [his matter. t/ <br />Yottr letter requests information on the "specific, concrete steps" Powderhom will take to obtain <br />a replacement perfommance bond. By this letter, Powderhom commits to pursuing athree-part plan to <br />seek to abate the NOV. It further commits to remain in close contact with the State with respect to its <br />abatement efforts. While Powderhor cannot be certain [hat it can obtain a replacement bond, as <br />requested by the State, it will aggressively pursue an alternative form of financial assurance. / <br />First, Powderhom will press Frontier to secure an alternative form of financial assurance for <br />Powderhom.
