OSM's petition is based exclusively on the agency azguments regazding the
Tatum's Exhibit A-15 -the December 1, 1997, decision of the District Court, County of Las
Animas, Colorado, in James (Jim) Tatum and Ann Tatum v. Basin Resources. Inc., No. 92 CV 127
("the state court decision"). Although neither of OSM's arguments has merit, the Board should
refuse even to consider them. Instead, the Tatums urge the Boazd to reject OSM's petition out of
hand because it constitutes a prohibited submission of the agency's position on the state court
decision. The Boazd expressly barred any such submission by order dated November 12, 1999.
Straightforward enforcement of that order requires the Boazd to deny reconsideration or a stay on
the grounds OSM asserts.
