OSM's petition is based exclusively on the agency azguments regazding the <br />Tatum's Exhibit A-15 -the December 1, 1997, decision of the District Court, County of Las <br />Animas, Colorado, in James (Jim) Tatum and Ann Tatum v. Basin Resources. Inc., No. 92 CV 127 <br />("the state court decision"). Although neither of OSM's arguments has merit, the Board should <br />refuse even to consider them. Instead, the Tatums urge the Boazd to reject OSM's petition out of <br />hand because it constitutes a prohibited submission of the agency's position on the state court <br />decision. The Boazd expressly barred any such submission by order dated November 12, 1999. <br />Straightforward enforcement of that order requires the Boazd to deny reconsideration or a stay on <br />the grounds OSM asserts. <br />
