Dear Mr. Dunn:
Pursuant to Rule 2.07.6(2)(d)(iv) of the Rules and
Regulations of the Colorado Mined Land Reclamation
Division, West Elk Coal Company, Inc must secure
the permission of the Colorado Department of
Highways to conduct activities related to it's
coal mining operations within 100 feet of the
outside right of way of State Highway 133.
Please find enclosed a set of plans and drawings
which outline the operations that West Elk Coal
• Company (WECC) proposes to conduct near State
Highway 133. The proposed operation is a refuse
disposal pile for material generated from the
mining operations.
The property that the proposed operations will be
located on is owned entirely by WECC. No
operations will be conducted on the right of way
of State Highway 133.
Drainage which normally flows into the highway
collection system from the WECC property will be
contained by a series of ditches and routed to a
sedimentation basin where the runoff will be
treated. The water from the sediment pond will
then be discharged back into the highway drainage
system. This water normally would drain into the
highway drainage system if the operation was not
in place. Any additional increase in peak
discharge due to the operation will be contained
in the sediment pond.
We respectfully request that the Colorado
Department of Highways respond in writing with
permission for WECC to conduct operations within
• 100 feet of the outside right of way and to allow
the treated drainage from the sediment pond to
enter the highway drainage system.
