Box 2107 <br />Grand Junction, Colorado 81502 <br />Dear Mr. Dunn: <br />Pursuant to Rule 2.07.6(2)(d)(iv) of the Rules and <br />Regulations of the Colorado Mined Land Reclamation <br />Division, West Elk Coal Company, Inc must secure <br />the permission of the Colorado Department of <br />Highways to conduct activities related to it's <br />coal mining operations within 100 feet of the <br />outside right of way of State Highway 133. <br />Please find enclosed a set of plans and drawings <br />which outline the operations that West Elk Coal <br />• Company (WECC) proposes to conduct near State <br />Highway 133. The proposed operation is a refuse <br />disposal pile for material generated from the <br />mining operations. <br />The property that the proposed operations will be <br />located on is owned entirely by WECC. No <br />operations will be conducted on the right of way <br />of State Highway 133. <br />Drainage which normally flows into the highway <br />collection system from the WECC property will be <br />contained by a series of ditches and routed to a <br />sedimentation basin where the runoff will be <br />treated. The water from the sediment pond will <br />then be discharged back into the highway drainage <br />system. This water normally would drain into the <br />highway drainage system if the operation was not <br />in place. Any additional increase in peak <br />discharge due to the operation will be contained <br />in the sediment pond. <br />We respectfully request that the Colorado <br />Department of Highways respond in writing with <br />permission for WECC to conduct operations within <br />• 100 feet of the outside right of way and to allow <br />the treated drainage from the sediment pond to <br />enter the highway drainage system. <br />AMCO-6204 <br />3 <br />
