We were hoping that Mr. Draper would allow us to <br />place the excavated material from RCR 27A along the shoulder of RCR <br />27 to minimize the disturbance on the Hallenbeck property. we <br />further explained that the revision submittal showed the "worst- <br />case" disturbance on the Hallenbeck property, since it included the <br />detour road for traffic while the dragline crossed RCR 27. This <br />detour would have caused approximately 4 acres of disturbance, <br />including the removal and reconstructing of a stockpond on the <br />Hallenbeck property. Neither you nor Larry asked about the work <br />associated with the widening of RCR 27A and why it was not <br />permitted by Seneca. <br />Mr. Draper did come out for our meeting in the morning on the 22nd. <br />Since we told him that RCR 27 would need to be closed for <br />approximately two hours to cross it with the dragline, he stated <br />that instead of doing all of the additional disturbance associated <br />with the extra detour road that the county will close the road the <br />morning of the crossing. He thought it was a good idea to use the <br />excavated material from RCR 27A and place it adjacent to RCR 27 <br />within our existing easement on this road, minimizing the <br />disturbance. Mr. Draper said that he had no problems with the <br />deadhead plans and informed us we could start the next day with the <br />widening of RCR 27A. <br />On Friday August 23, i called Larry and left a voice message that <br />we had received approval from Routt county to go ahead with <br />widening RCR 27A and to place the fill alongside RCR 27, within the <br />existing county road easement. When the Yoast permit was approved <br />in August 1995, the county requested that we add a turn lane in <br />both directions at the intersection of RCR 27 and Yoast Haul Road <br />"A" for safety reasons. These two lanes were not included in the <br />Yoast permit area, yet they were discussed with the Division, since <br />they were constructed at the request of the county. We felt the <br />fill along RCR 27, associated with the widening of RCR 27A, was a <br />similar circumstance since the county approved it even though TR-03 <br />had not yet been approved. Work started that morning. <br />On Monday August 26, we had a phone conversation on several issues <br />and I mentioned to you that we started the work on widening RCR <br />27A. within the hour, Larry called me back asking several questions <br />about this work. i asked him if the Division had a problem with <br />what we were doing, i would be happy to stop the work until we were <br />given the go ahead by the Division. Larry said that we could <br />continue with the widening. Seneca received the oversize permit to <br />walk the dragline on RCR 27A and RCR 27 on August 28, a copy was <br />faxed to you on August 29. We received the Administrative Permit <br />from the Routt County Regional Planning Commission, for this <br />deadhead project on August 30. <br />
