Unfortunately, i have identified <br />almost as many problems this time around as I did originally. You <br />should be able to access the entire document under <br />m:\coal\dtm\eglmdtr2.mem. If not, check Larry's mail Monday or <br />Tuesday (I'll mail it Saturday Morning). <br />16. The operator's response to this item did not specifically <br />address the requirement of Stipulation No. 3 regarding <br />documentation of the availability of sufficient non-toxic, non- <br />combustible cover material to replace 4 feet of cover over the <br />proposed refuse area. The operator will need to demonstrate that <br />sufficient material of suitable quality is available to be salvaged <br />within the area to be affected by the disposal site, or will need <br />to identify an alternative source of sufficient suitable material. <br />Should the operator wish to pursue a variance to the four foot <br />cover depth requirement, the initial step would be to provide a <br />thorough physical and chemical characterization of the refuse <br />material and to assess the potential toxicities or other inhibitory <br />qualities which could negatively impact successful reclamation. <br />Determination of the need for vegetation studies and design <br />considerations would follow from that initial assessment. <br />Prior to placement of any refuse material in the proposed disposal <br />area, the operator will need demonstrate the availability of <br />sufficient suitable material to reclaim the disposal site in <br />accordance with the permit and regulations. The operator should <br />include a commitment to this effect in the application, or the <br />stipulation should be modified accordingly. <br />17.
