Please read this carefully so you can avoid <br />these penalties. <br />i, <br />Mandatory Penalties <br />,~ The Act re uc7 ices a penalty of not less than'$750'per day . <br />'~~ for eacf: violation which you fail to correct- on time. This <br />~'~~r'"%"~ - enalt must be assassed for each da from the date set for <br />;~,... <br />"'~•~"~ 'abatement in the notice or order until you have corrected <br />"'"'~' the violation. This minimum $750 <br />,: ,;; per day penalty is in . <br />addition to any penalty you may be assessed for the violation <br />:;~.:'., contained in the notice or order., Tfrus, by failing to <br />correct a violation on time, you may he assessed two separate <br />penalties. <br />Ttre minimum 5750/day penalty can run u ~ c~uick~ to a <br />very large amount. IF you miss the aF,e~tement date for only <br />one violation by only 10 days, the penalty will' be at least <br />57,500. flecause each violation in a notice or order is <br />treated as a se~,arateiiotice or order for purposes of this <br />' ~enalty~, this amount would multiply by the number of <br />violations. <br />Other Penalties <br />In addition to the r~uired penalties, you may be.subject <br />to the £o lowing action i£ you do not correct the violation: <br />~.. Ycu mdy be served with a cessation order requiring <br />you to stop mining immediately. ` <br />2. The Office of Surface Mining may seek a~court order <br />to close your operation. Violation of a court order is <br />contempt of court, and can lead to imprisonrient. <br />~ 3. The Office of Surface Mining may refer your case for <br />criminal pc-osecution, which could subject you to a maximum <br />sentence of up to 510,000 or one year in prison or both. <br />4.
