C-2001-003 <br />During the term of the first five years of the Ten Year Reclamation Liability Period, <br />Energy Fuels understands that it has the opportunity to observe the vegetation success and <br />has the option to amend the growth trends if deemed necessary. In this sense, the <br />proclaimed "violation" is not of a permanent nature but is amendable prior to the latter <br />term of the liability period. <br />PROPOSED REMEDIAL ACTION FOR N.O.V. C-2004-003 <br />Following consultation with and the approval of the Division and the property owner (Dr. <br />Corley), Energy Fuels proposes the following: <br />- Based on the landowner's (Dr. Corley) seed recognition as stated, EFCI will <br />submit a Minor Revision Request to include the Crested and Intermediate <br />Wheatgrass in the approved seed mix for the Corley property. (The Fourwing <br />Saltbush was eliminated from the March 2003 revision via Footnote 2); <br />- "Interseed" the Indian Rice Grass by hand seeding at double the rate of PLS/ft2 of <br />the approved rate for drill-seeding. The Indian Rice Grass would only be applied to <br />ground `slopes' which, as it is believed, tends to be it's more natural habitat; <br />- EFCI will demonstrate that the seeding rate either was or will be interseeded at the <br />approved rate, PLS/ft2, following the prescribed consultation with the Division; <br />- Complete the above action on or before October 31, 2004 as directed in the <br />N.O.V. <br />Sincerely, <br />George V.
