On February 25 1982, the Mined Land Reclamation Board of <br />the Colorado epartment o Natural Resources (the "State") granted to <br />Western Mobile Northern, Inc. <br />Denver, CO 80221-2425 <br />81-276 (the "Permit") pursuant <br />mining and reclamation operation <br />Colorado. <br />successor to MobilgP~de~ressompany D n,_,__O1__Oe,,,,. ~ <br />1588 <br />("Pennittee") pennit number <br />to which Pennittee has been conducting a <br />in the County of Moffat state of <br />B. Pennittee wishes to assign the permit to Wes Hertzoa Truckino <br />address 825 Ashley Rd., Craia, CO 81625 <br />as Successor Operator (":successor") <br />an uccessor w1s es to become uccessor ermittee under the permit. <br />C. Successor understands that the reclamation plan (the "Plan") <br />required by the permit and by applicable State laws and regulations teas not <br />been completed and is willing to assume full responsibility for the completion <br />of the Plan. <br />II. <br />AfRFFMFNTS <br />Pennittee and Successor hereby agree, far their own benefit and for the <br />benefit of the State, such agreements to be effective ipso facto upor~ the' <br />approval by the State of the transfer of the Permit from Pennittee to <br />Successor, as follows: <br />1. Successor has inspected the mining and reclamation operations to its <br />entire satisfaction and is fully aware of the condition thereof. Successor <br />understands and accepts all of the conditions of the Permit. <br />2. Successor will complete the reclamation plan, and hereby assumes <br />liability for completing such plan as to all areas heretofore disturbed, as <br />well as to all areas hereafter disturbed.
