("Lawrence") and Cooley <br />Gravel Company ("Cooley") move for an extension of time in <br />which to submit an amendment or technical revision of <br />Reclamation Permit No. 74-41 (the "Permit") to the Mined Land <br />Reclamation Board ("Board"). As grounds for this motion, <br />Lawrence and Cooley state: <br />1. Based upon the findings of fact and notice of <br />violation made at the Board's June 26, 1985 public hearing, <br />the Board ordered Lawrence to submit an amendment or technical <br />revision of the Permit to the Board at or before the September <br />25-26, 1985 Board Meeting. <br />2. The following corrective actions have been taken <br />with regard to the Lawrence Pit: <br />a. Pumping and discharge of water have stopped; <br />b. Settling ponds emptied and drying; <br />c. Disturbed riverine areas undergoing initial <br />reclamation; <br />d. Topsoil salvage and protection corrected. <br />3. The Board approved the transfer of the Permit <br />No. 74-41 to Cooley Gravel Company on June 26, 1985. However, <br />because of a number of pending and unresolved disputes, Cooley <br />has been unable to assess the current operation in light of <br />its own needs since that time sufficient to determine whether <br />an amendment is necessary or whether certain technical <br />revisions will suffice. Lawrence and Cooley have been unable <br />to agree on the contents of the submission in light of this <br />uncertainty about future operations. <br />WHEREFORE, Lawrence and Cooley move for an extension <br />of time to submit proposed amendment and or technical revision <br />to the Permit correcting the violations noted by the Board. <br />An extension is requested up to the Board's November 1985 <br />meeting. It is also requested that the remaining $3,000 civil <br />penalty be suspended during the period of extension. <br />
