.~
June 4, 1984
.,f
A,ark Loye f"~ '
1313 Sherman
Rm. 423
Denver, Co. 80203
C/U I•:ine Land Reclamation Div.
Dear r9r. Loye:
~ iii iii~iii~i~~i~~~~
RECEIVED
JUN 11 lyri<I
MINED LAND RECLAMATION DIVISION
Colo. Dept. of Natural Resources
Pry property lies adjacent to the property of Fremont Paving
and Beady prix Company in Canon City, Colorado. I believe this
company is in violation of mine land reclamation require::,ents
or quidelines.
The Fremont Paving and Ready D1ix Company over a year ago was
granted a special use permit by the Fremont County Board of
Commissioners to expand what was then a non-conforming gravel
mining and batch plant operation. recently, within the past
month, Fremont Paving has begun washing and dumping ~;iaterial
from concrete trucks near their northwest property line. The
material then runs down a ravine or gulch and onto Santa Fe
Road, a public gravel road providing access to my property
and others west of mine. This dumping creates a nuisance by
producing a slurry that covers aaproxirnately 100 feet of road
surface. Besides being an eyesore and a nuisance to drive
through the problem will undoubtly become worse if Fremont
Paving is allowed to continue this _practice. I have called
the company's office on two occassions within the past two
weeks asking that the company do something to prevent this
situation, but nothing has been done and they continue to dump
their trucks in the sarue area. Therefore I have notified your
agency in hopes that Erer~ont Paving can be required to dis-
continue this practice and clean up what they have already
done.
I am also sending a copy of ltiiis letter to the Fremont County
Board of Commissioners in hopes that they would have some
jurisdiction in the matter since it involves a public road.
I would appreciate your earliest investigation. Thank jrou.
S~ncerely,
I ~
Lowell Soester
CC Fremont County Bd. of Commissioners
