Lung
Diaision Direanr
We have received, from the Pittsburg and Midway Coal Mining Company, a request to extend
the abatement periods for the above mentioned notices of violation. The request was to
extend the deadlines to October 17, 1993. "I'he original abatement due dates were ninety days,
ending July 4, 1993. We extended the abatement periods an additional sixty days to
September 2, 1993. I notified P&M that we would not extend the deadlines beyond October
2, 1993, the end of a second ninety day period from issuance. We are currently awaiting a
response to our adequacy concerns on two technical revisions, the approval of which would
facilitate on the ground abatement of the notices. I believe P&M is eligible for an extension
based on Rule 5.03.2(2((c)(i), in that they continue to diligently pursue approval of the
required revisions. Therefore, I am requesting that you authorize the attached extension
forms. I have attached P&M's request and the Division's initial response for your review. If
you need additional information, please let me know.
SLB\083093.WP
