The permittee shall report the following instances of noncompliance orally within [wenty-four (24) hours from the <br />time the permittee becomes awaze of [he noncompliance, and shall mail to the Division a written report w'th' ve <br />(51 days after becoming awaze of the noncompliance: <br />1) Any instance of noncompliance which may endanger health or the eavuonment; <br />2) Any unanticipa[ed bypass which exceeds effluen[ limitations; <br />3) Any upse[ which causes an exceedance of any effluent limitation in the permit; <br />4) Any spill which causes any effluent limitation to be viola[ed; <br />5) Daily maximum violarions for any toxic pollutants or hazazdous substances litni[ed by Part I.B of [his <br />permit and specified as requiring 24 hour notification. This includes any toxic pollutant or hazardous <br />substance or nay pollutant specifically identified as the mc[hod m control any toxic pollutant or hazazdous <br />substance. <br />c. The permittee shall report all other instances of non-compliance not requiring 24-hour notifieation a[ the time <br />Discharge Monitoring Reports are submitted. The reports shall contain the information listed in sub-pazagraph a. <br />of this section. <br />4. Submission of Incorrect or IncomQlete Information <br />Where the permittee failed to submit any relevant facts is a permit application, or submitted incorrect information in a <br />permit applicarion or report to the Division, [he permittee shall promptly submit the relevant application information <br />which was not submitted or any additional information needed to correct any erroneous information previously submitted. <br />5. Broacs <br />The permittee may allow any bypass to occur which does no[ cause effluent limitations [o be exceeded, but if and only if <br />i[ is for essential [naintettance to assure efficient operation. These bypasses are not subject to the provisions noted in item <br />b. below. Division notification is not required. <br />Bypass is prohibited, and the Division may take enforcement action against a petmit[ee for bypass, unless: <br />a. Bypass was unavoidable to preven[ loss of life, personal injury, or severe property damage; <br />b. There were no feasible alternatives to the bypass, such as the use of atuiliary treatment facilities, re[ention of <br />untreated wastes, or maintenance during normal periods of equipment downtime. This condition is not satisfied if <br />the permittee could have installed adequate backup equipmem to prevent a bypass which occurred during normal <br />periods of equipment downtime or preventative maintetance; and <br />c. The permittee submitted notices as required in "Bypass Notification", Patt II.A.6. <br />6. )amass Notification <br />If the permittee knows in advance of the need for a bypass, a notice shall be submitted, at least ten days before the date <br />of the bypass, to the Division and [he Environmen[al Protection Agency (EPA). The bypass shall be subject to Division <br />approval and limitations imposed by the Division and EPA. <br /> <br />
