I believe your <br />letter clears-up most of the questions we have regarding this matter. <br />I was quite surprised to learn you will be pulling pillars in three panels <br />in Section 20 during the next year to obtain subsidence data. As the surface <br />land owner of this Section we are concerned that your mining activities may <br />decrease the value of our tend. You may not he aware that we own conditional <br />decreed water rights on two springs in Section 19 and one spring in Section <br />20. We also consider the associated ponds and surface water conveyances, <br />natural or man-made, to be valuable assets inseparable from the land. <br />Attached you will find the Consent Agreement signed on behalf of Grand Mesa <br />Properties Company. Please note the change we made 1n paragraph three of <br />the~Agreement: Ne have approved the Consent Agreement even though it seems <br />premature to "assess, monitor and mitigate". Taking an inventory of the <br />structures, springs, ponds and water conveyances in the area of influence <br />of your three panels appears to be the first step West Elk should take after <br />being granted the right to enter the property. <br />As stated above, we are very concerned that surface subsidence may decrease <br />the value of our land. Please refer to Section 4.20.2 of the Regulations <br />of the Colorado Mined Land Reclamation Board for Coal Mining which is quoted <br />below. <br />4.20.2 Public Notice <br />The mining schedule shall be distributed by mail to all owners <br />of property and residents within the aree above the underground <br />workings and adjacent areas. Each such parson shall be notified <br />by mail at least six months prior to mining beneath his or <br />her property or residence. The notification shall contain, <br />in minimum: <br />(1) Identification of specific areas in which mining <br />wilt take place; <br />(2) Dates of mining activities that could cause subsidence <br />and affect specific structures; and <br />(3) Measures to he taken to prevent or control adverse <br />surface•effetts. <br />
