Wright, OSM <br />Comments <br />This was a complete random sample inspection done to evaluate the State of <br />Colorado's performance in administering their program and to determine if the <br />New Elk Mine was operating in accordance with the program regulations. <br />Paperwork and records was reviewed at the mine office during the morning of <br />August 10. Facilities were inspected during the afternoon of August 10, all day <br />on August 11 and the morning of August 12. <br />The Colorado Division of Minerals and Geology (DMG) had no enforcement <br />actions outstanding on this site when this inspection began. As a result of this <br />inspection DMG issued the three violations listed below: <br />Notice of Violation C94-018 was issued for failure to pass disturbed area <br />drainage through a sediment pond or treatment facility. This violation covered <br />the western portion of the western-most coal stockpile, the south bank of the <br />river under the conveyor belt, the area east of the coal silo and the west reno <br />mattress at the RDA. This violation has an abatement deadline of August 26, <br />1994. <br />Notice of Violation C94-019 was issued for failure to maintain ditches and <br />culverts and covered culverts C-17, C-35, C-36 and C-10 and ditches D-11, D- <br />2 and D-6A. This violation has an abatement deadline of August 16, 1994. <br />Notice of Violation C-94-020 was issued for failure to maintain pond primary <br />spillway structures and covered the pond #8 spillway and pond #7 gate valve. <br />This violation has an abatement deadline of August 26, 1994. <br />
