During that
inspection the Federal inspector raised a number of issues that were
allayed by the immediate issuance of Notice of Violation No. C-87-021.
That Notice of Violation addressed the inadequate bond and mine plan
deficiencies. Copies of the Notice of Violation are attached.
With this letter I want to express that the Division desires to continue
to work with Kaiser Coal Company and U. S. Steel to resolve these
issues. The assignment by Kaiser Coal Company of William Balaz and Jim
Gratwohl to work with the Division to modify the mine plan is a positive
step forward. However, ultimately resolving the issue will require
posting of adequate bond which neither party has expressed an ability to
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
