Box 511
Aguilar, Colorado 81082
Re: Proposed Settlement Agreements for NOV's C-84-062, C-84-063 and C-84-061
Dear Mr. Madden:
Enclosed please find proposed Settlement Agreements for the above cited
NOV's. These proposals are forwarded to replace the set inadvertantly mailed
earlier today, lacking the appropriate date opposite my signature as
Conference Officer. Please ignore those earlier incomplete Settlement
Agreements.
These proposals are based on information presented at the assessment
conference held in our office on Tuesday, July 3, 1984. In attendance during
that assessment conference 1n addition to you and I, was Larry King, of your
staff, and Sue Mowry and Brian Munson of the Division's staff. If you agree
with the proposals, please sign them and return them to the office as
Instructed on the form. If you disagree, we will fix the civil penalty and
you may appeal that decision to the Board as outlined in our regulations.
During the Assessment Conference I stated that I would consider a good faith
ad,~ustment concerning NOV C-84-067. My final decision was not to grant an
adjustment for good faith regarding that NOV. It is my final opinion that the
operator's instigation of the revision process is not adequate reason for a
good faith ad3ustment.
If you have any questions, please do not hesitate to contact me.
,\\ .
Sincere=Ty, } ~
I
<<ti~.t,.t~~
~ames Pendleton
Conference Officer
Enclosure
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tet.
