Banta. <br />Division Director <br />Based on my inspection of November 11, 1989, Notice of Violation C-89-031 was <br />issued for failure to maintain the drainage control system in accordance with <br />the approved plan. Abatement No. 1 required the operator to "maintain the <br />entire drainage control system so that all ditches and culverts are clear of <br />debris, and so that all ditches are in compliance with the dimensional <br />requirements specified on Plate ]" of the permit document. This was to be <br />completed by December 1, 1989. <br />Much of the maintenance had been completed as of a November 27, 1989 <br />inspection; however, some work remained outstanding due to winter weather and <br />around conditions. The Division Director issued an abatement extension to <br />March 1, 1990 as allowed under the provisions of Rule 5.03.2(2)(c). <br />During the week of February 26 - March 2, 1990, but prior to March 1, 1990, <br />h1r. David Canning called to request a further extension due to deep snow cover <br />over the site. A formal written extension re guest, dated February 28, 1990, <br />was received on March 5, 1990. <br />A brief inspection of the area on March 8, 1990 verified that the around is <br />indeed buried under 2-3 feet of snow. The operator has requested an extension <br />to April 30, 1990. <br />I hereby request the concurrence of the Administrator, in accordance with Rule <br />5.03.2(2)(e), regarding the requested extension to April 30, T990. I feel <br />that this is the shortest possible time required to complete the abatement, <br />and that sufficient interim measures have been completed to minimize harm to <br />the Dublic or to the environment. <br />DAB/yjb <br />5080E <br />
