LonK <br />Division Director <br />I reviewed the new ownership and control information submitted for <br />the Seneca II and Seneca II-W mines dated July 28, 1994. I also <br />conducted an AVS decision check, the system recommendation remains <br />at CONDITIONAL ISSUE. Please see attached for further detail. I <br />have one final concern that should be addressed by the operator; <br />1. The revised permit pages indicate the ownership relationship <br />tied to Seneca Coal Company. Parent companies are also listed <br />as Share holders and owners. The operator should specify the <br />percent of shares held by the company and the percent <br />ownership of one company to another. For example. Peabody <br />Holding Co,~ is listed as 1001 share holder in AVS. This 100 <br />ownership should be listed in the permit pages. Another <br />example is that Hanson America Inc. and Hanson Holdings <br />Netherlands BV are both listed in the permit pages as owners <br />of HM Holdings Inc. In AVS, Hanson America is 84$ owner while <br />Hanson Holdings Netherlands BV owns only 14$.
