~` ~ III IIIIIIIIIIIIIIII ~ <br />999 <br />MINED LAND RECLAMATION DI4ISION <br />CEASE AND DESIST ORDER <br />1(t~ W ~~Sn1(I~~~~'G7vL~'ocetion: <br />(Operator/Comp'a'ny' name) <br />Address: ~ <~l ~n ~~ ~~~ (Legal <br /> <br />Phone: C~~ cl a~"~ --'"]~~ <br />_~.i~ ~ ~,- rr <br />(Operation Type) <br />- Section, Township, Range) <br />(Distance and direction from nearest city) <br />~ (County) CrJ~ <br />(Commodity Mined) <br />The Mined Land Reclamation Division ("the Division") has conducted an inspection of <br />the above-referenced operation and has determined that you are: <br />~ conducting a mining operation without a permit in violation of <br />C.R.S. 34-32-109(1). <br />_ Prospecting without having fired a notice of intent to conduct <br />prospecting operations as required by C.R.S. 34-32-113(1). <br />Whenever an operator or prospector fails to obtain a valid permit or file a Notice <br />of Intent to Conduct Prospecting, the Board or Division may issue an immediate cease <br />and desist order, except that only the Board can issue a cease and desist order for <br />operators who affect acreage beyond the approved permit boundary. Concurrently with <br />the issuance of such an order, the Board or Division may seek a restraining order or <br />injunction. <br />C.R.S. 34-32-123(2) and (3) provides for imposition of civil penalties of $1,000 to <br />E6,000 per day ($50 to $200 per day for prospecting and limited impact operations) <br />for each day the land has been affected for up to a maximum of 60 days. <br />You are ordered to immediately cease and desist all mining and prospecting <br />activities other than those required to prevent damage to off-site areas or protect <br />the public health and safety. <br />The Division will send a report on this inspection within 10 days. You will <br />receive a notice, by Certified Mail, of a hearing to be held to consider the <br />possible violation.
