Rollings, 370, OSM <br />Steve Rathbun, OSM <br />Janet Binns, DMG <br />Larry Reschke, PCC <br />Enforcement Actions <br />This inspection resulted in three Notices of Violation (NOV) being issued to PCC by _ <br />the Division of Minerals and Geology (DMG) and one Ten-Day Notice (TDN) with <br />two violations issued to DMG by OSM. The NOVs were issued as follows: <br />NOV# C-92-36 cites 4.11.4. This was issued for non-coal waste stored <br />at the North Decline area. The runoff from this unapproved storage area did not <br />pass through a siltation structure. The operator removed the material the night <br />after it was observed. The material consisted of power poles, rock dust, etc., and <br />was benign in nature. <br />NOV# C-92-37 cites 4.03.2 (4). This NOV was issued for failure to <br />maintain drainage on access road 6. There were three problems with this road; <br />the south side ditch had eroded to about 42" at the deepest point, the north side <br />ditch had apparently failed at one time (probably filled with sediment and <br />overtopped) and runoff had gone across an undisturbed area and created a gully <br />on the outslope, and the north side ditch is not presently cut to specifications., <br />PCC will have to regrade the two ditches and repair the gully on the slope. <br />NOV# C-92-38 cites 4.10.3 (2). This NOV was issued to address the <br />erosion in the ditch around the Cameo Refuse Disposal Area (CRDA) #1. The <br />ditch is eroded and does not have any channel lining. It was apparent that this <br />ditch has had problems in the past. Hay bale remnants that had been graded over <br />appeared in part of the ditch. DMG will require PCC to riprap this ditch to meet the <br />design standards. <br />
