Notes New Pryor Amer. Fuels - 5 - July 23, 1985
a. Soil stockpiles not stabilized, subject to severe erosion
b. backfilled pit not stabilized, subject to severe erosion
c. respread topsoil not stabilized, subject to severe erosion
d. no sediment control for southern pit area
e. five NOV's of CO's have not yet been abated.
3. Except for trips to the area once a month to pick up mail,
the site would appear to be abandoned.
B. American Fuels, Inc. appears to lack the financial ability,
experience, or desire to operate the mine in accordance with their
approved plan.
C. American Fuels, Inc. owes the state of Colorado $61,300 in unpaid
penalties.
Due to problems detailed above, track-record of American Fuels, Inc. with the
Division, un-paid penalties, and the shortness of the bond, we recommend that
the permit be revoked. We also recommend, if the Board pleases, that a
compliance schedule be adapted and American Fuels, Inc. ordered to comply with
the schedule or bond forfeiture proceedings will commence.
ljc
1888E
