Blue Ribbon Coal Company shall determine the adequacy of revegetation at the midpoint of bonding liability period. We are assuming the midpoint to be four (4) years, as the revegetation success criteria must be met for at least the last two (2) consecutive years of the ten (10) years bonding liability period. We are allowed to interseed or transplant native species, repair rills and gullies, and induce weed control within the first five (5) years of the ten (10) year liability period with the Division's approval. Assuming the midpoint to be four years and the last opportunity to interseed or transplant native species to be the fifth (5th) year, Blue Ribbon Coal Company would have one (1) year to perform "appropriate action". Appropriate action as defined by Blue Ribbon is the amount of interseeding or transplanting of native species, repair of rills and gullies, weed control and other such action approved by the Division which shall not reinitiate the ten (10) year bonding liability period. Irrigation as suggested by the Division clearly reinitiates the period of liability referencing 3.02.3(2) and 4.15.7(5). Blue Ribbon Coal Company shall commit to a minimum of 400 stems per acre at the "fourth year midpoint" of the ten (10) year bonding liability period. If the 400 stems per acre woody plant density standard is not met then appropriate action as described above shall be initiated.
