We are assuming the midpoint to <br />be four (4) years, as the revegetation success criteria must be met for <br />at least the last two (2) consecutive years of the ten (10) years bonding <br />liability period. We are allowed to interseed or transplant native species, <br />repair rills and gullies, and induce weed control within the first five (5) <br />years of the ten (10) year liability period with the Division's approval. <br />Assuming the midpoint to be four years and the last opportunity to interseed <br />or transplant native species to be the fifth (5th) year, Blue Ribbon Coal <br />Company would have one (1) year to perform "appropriate action". Appropriate <br />action as defined by Blue Ribbon is the amount of interseeding or transplanting <br />of native species, repair of rills and gullies, weed control and other such <br />action approved by the Division which shall not reinitiate the ten (10) <br />year bonding liability period. <br />Irrigation as suggested by the Division clearly reinitiates the period of <br />liability referencing 3.02.3(2) and 4.15.7(5). <br />Blue Ribbon Coal Company shall commit to a minimum of 400 stems per acre <br />at the "fourth year midpoint" of the ten (10) year bonding liability period. <br />If the 400 stems per acre woody plant density standard is not met then <br />appropriate action as described above shall be initiated. <br />
