Proposed Settlement Agreements for the above noted Notices of
Violation (NOVs) are enclosed, along with assessment conference
summaries and narrative justifications for the proposed settlement
amounts. The assessment conference for each of the NOVs was held
in the offices of the Division on May 11, 1993. You, Wayne
Erickson, Terry Crowner, and Brian Gontarek were present,
representing Pittsburg & Midway Coal Mining Company (P&M). Larry
Routten and Susan Morrison represented the Division, and I was the
Assessment Conference Officer.
For each of the Settlement Agreements enclosed, please sign the
form and return a signed copy to the Division if you concur with
the settlement proposal. If you do not agree with the settlement
proposal, do not sign the form. The Division will fix the penalty
and you will have the opportunity to appeal the fact of the
violation and/or the amount of the penalty to the Mined Land
Reclamation Board.
