Box 860 <br />Canon City, Colorado 81212 <br />RE: Fremont Paving and Redi-Mix, Inc.'s "McKenzie Pit," <br />Fremont County, file No. M-80-224 <br />Dear Mr. Gellenthien: <br />iiiiiuiiiiiiiiiiii <br />Your letter of August 16, 1985 with the "amended Findings of Fact" was <br />received by the Division on August 19, 1985. <br />Paragraph 1 of the Findings of Fact has been changed to read as follows: <br />"1. Fremont Paving and Redi-Mix, Inc. is conducting a mining <br />operation. .". <br />After reviewing File No. M-80-224, Fremont Paving and Redi-Mix, Inc.'s <br />"McKenzie Pit," it became apparent that two permits were issued for the <br />operation. The original permit was issued on January 6, 1981; the second <br />permit was issued on October 27, 1983 following the Board's approval of the <br />conversion from a Limited Impact (110) to a regular (112) operation. <br />The permit issuance anniversary date is the date on which annual report, maps <br />and fees are due. The permit anniversary date has been changed from January 6 <br />to October 27. <br />Therefore, Paragraph 3(c) of the Findings of Fact has been deleted, as the <br />1985 Annual Report, map and fees were not due until October 27, 1985. <br />Page 3, sub-paragraph 2, line 4-5 of the Board Order has been changed to <br />read: ". 5 days during which oil was diverted to the irrigation ditch." <br /> <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
