4 • ~ III IIIIIIIIIIIII III <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br /> <br />auc <~ ~sss <br />RECLq(~ATIOnAND <br />f111/IStnF~ <br />REQUEST FOR PARTY STATUS OF MANSFIELD DEVELOPMENT CORPORATION <br />IN THE MATTER OF CASTLE CONCRETE COMPANY, SNYDER QUARRY, EL PASO <br />COUNTY, <br />Permit No. M-77-210 (Violation hearing) <br />Mansfield Development Corporation ("Mansfield"), by and <br />through its attorneys Ireland, Stapleton, Pryor & Pascoe, P.C. <br />hereby requests status as a party in the Formal Public Hearing to <br />be held by the Mined Land Reclamation Board ("MLRB") on <br />August 23-24, 1989 regarding the matter of alleged violations in <br />the above referenced matter; and as grounds therefore, Mansfield <br />states to the Board as follows: <br />1. Rule 1:115 (13)(f) of the Mineral Rules and <br />Regulations of the Colorado Mine Land Reclamation Board ("Rules") <br />provides in part that any person who may be affected or a~39rieved <br />by decisions to be made at a hearing of the Hoard shall b~~ <br />admitted as a party to the hearing upon filing with the Division <br />a written Request for Party Status. <br />2. There is now pending before the Board a mater <br />captioned "In the Matter of Castle Concrete Company, Snyder <br />Quarry Amendment, Permit No. M-77-210, AM-03" which conce:_ns the <br />same permit which is the subject of the alleged violationsa to be <br />heard at the Formal Public Hearing. In said Amendment ma{:ter, <br />pursuant to the Supplemental Prehearing Order dated June ~9, 1989 <br />issued by the Board, Mansfield Development Corporation wa:a <br />admitted as a party to the proceedings and allowed to participate <br />in person or by counsel. <br />3. Mansfield should be admitted as a party to i:he <br />subject hearing as a person who may be affected or aggrieved by <br />decisions to be made at the subject hearing. <br />4. Mansfield is the owner of a real property interest <br />in property adjacent to the property which is the subject of the <br />
