(Page 2) <br />MINE ID # OR PROSPECTING ID #: ~~-~nn.~_nm <br />INSPECTION DATE: inns ~nry ~o ~nn~ INSPECTOR=S INITIALS: a i~nr <br />OBSERVATIONS <br />This inspection was conducted by Tony Waldron of DMG as a result of a citizen's complaint received on <br />January 17, 2003. Present during the inspection were Joe Gagliano and Rex Angelovich representing Stone <br />Cliff Investments, who is the developer of the subject property. The complaint alleged that gravel processing <br />had been occurring on the site for several weeks. The letter was accompanied by several photos clearly <br />showing gravel mining or processing activities occurring. The site is also the subject of an active application on <br />file with the division fora 110c reclamation permit. The decision date for that application is February 26, 2003. <br />The site is located approximately 4 miles east of I-25 and 10 miles north of Walsenburg, Colorado in Huertano <br />County. <br />At the site, which appears to be an abandoned gravel pit, there is an active crushing/screening operation in <br />progress. The operator, Rex Angelovich, indicated that no new excavating had occurred and they were just <br />processing the stockpile of abandoned gravel/overburden. Obviously this has caused some incidental <br />disturbances, but it did not appear that any new excavation has been occurring. According to Mr. <br />Angelovich, the material is being used to surface newly constructed primary roads in a 35-acre development. <br />The operation is being conducted entirely on land owned by Stone Cliff Investments including both the <br />crushing and road construction. Mr. Angelovich is the contractor conducting this activity for Stone Cliff. <br />The pit is situated on the north side and adjacent to, but up out of, a small ephemeral drainage. The <br />surrounding area is typical shortgrass prairie common to Eastern Colorado and should not present a problem <br />during reclamation. The entire existing disturbance will be encompassed within the proposed permit <br />boundaries of the new application and will therefore be reclaimed under that permit if it is approved. <br />The operator did not contact the Mined Land Reclamation Board for a determination of whether or not the <br />activity required a reclamation permit and there is obviously a mining related activity occurring. Furthermore, <br />since the office received a written complaint on this activity, policy is to place it on the agenda for the next <br />regularly scheduled meeting of the Mined Land Reclamation Board for a determination of whether or not the <br />activity constitutes mining without a permit. Therefore, a letter is being sent To the operator(s) indicating that <br />The division has reason to believe That a possible violation exists at this site for failure to first obtain a reclamation <br />permit prior to engaging in a mining operation. This matter will be placed on the agenda for the February 25- <br />26, 2003 Mined Land Reclamation Board Meeting.
