CO 80233 Division Director <br />RE: M&G Pit, Technical Revision No. 4, Permit No. M-86-079 <br />Dear Ms. Acre: <br />I have reviewed your December 16, 1998 revision request to leave the M&G Pit north wash pond <br />"as is" rather than backfilling with overburden materials. I have three (3) adequacy concems that <br />require your attention. First, please provide an updated Well Location Map to indicate whether <br />any wells have been installed within 600 feet of the north wash pond since 1986. If there are any <br />wells within 600 feet of the north wash pond, you may be required by the Office of the State <br />Engineer to provide a demonstration of no adverse impacts. Second, please clarify the acreage of <br />exposed water surface to be left "as is". Your November 23, L998 correspondence specifies <br />"The current permit calls for a single groudwater lake of approximately 61 acres with the north <br />end to be backfilled to leave approximately 22 acres of potentially developable property..The <br />property nowner now wishes to leave the entire area as a groundwater lake. This would create a <br />groundwater lake of approximately 83 acres." The Reclamation Plan Map you provided on <br />November 24, 1998 shows the north wash pond to be approximately 12 acres. Also, the Division <br />estimated the acreage of the north wash pond to be 10 acres during a July I, 1998 site inspection <br />with Mr. Ben Frei and Steve O'Brian. Third, please verify that the operator and/or landowner <br />has an approved water aumentation plan or temporary substitute supply plan to account for <br />evaporative loss over the entire water surface to be exposed, including the north wash pond. <br />Please provide a response to the three concerns listed above on or before January 29, 1998. <br />Sincerely, <br />Thomas A.
