The last two sentences of the response are contradictory: <br />One indicates there was no violation; the other infers that an <br />enforcement action is appropriate. Gary Fritz said that he discussed <br />the contradictions in the letter by phone with you on the November 5, <br />1987. After reviewing it, he said that you indicated the Division's <br />stance on the TDN is, "that no violation existed at the time of the re- <br />inspection." Gary also said that you would send us a revised letter <br />to verify your position in this matter. <br />Based on the oral confirmation of the 5th and your forthcoming letter, <br />OSMRE has reviewed your Division's response to the above-mentioned Ten- <br />Day Notice (TDN). <br />OSMRE finds MLRD's response to violation No. 1 of the TDN appropriate. <br />OSMRE also finds your office's response to the second violation of the <br />TDN appropriate. <br />Sincerely, <br />H.
