Walther Executive Director bLChael B. long DivifiOn Dbeaor The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on April 4, 2001, an application to revise coal mining operations at the Coal Ridge No. 1 Mine was considered complete for the purposes of filing. The revision was submitted by NCIG Financial, Inc. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. This proposed technical revision (revision) includes a demonstration that untreated drainage from reclaimed areas contributes suspended solids off site less than or equal to premining levels. The underground coal mining operation is on land located approximately 7 miles west of Glenwood Springs, Colorado. The permit azea is further described as follows: T6S, R91 W; Portions of Sections 1 and 32 T6S, R90W; Portions of Sections 5, 6, 7, 8, 9, IS and ]6 The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Storm Icing Mountain and New Castle The proposed technical revision would not incorporate additional lands into [he permit area or alter previously approved permit conditions or mitigation measures. in order for us to approve this revision, however, we are required to make a finding that "the activities would not affect the continued existence of endangered or threatened species or result in the destruction or adverse modification of their critical habitats as determined under the Endangered Species Act of 1973....". Therefore, we are requesting your agency's evaluation of the potential for impacts to threatened or endangered species of plants or animals, or wildlife species otherwise protected by federal law. The applicant is required to publish notice in a local newspaper that this application has been deemed complete. At the time of publication of this notice, the applicant is additionally required to place a copy of this application at the Ga~eld County Courthouse, 109 8th St Ste 200, Glenwood Springs, CO 8]601, and at the Division office.
