~~o~~~° Or~~Pr~ <br />~L~ <br />BEFORE T E MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO , <br />FINDINGS OF FACT, <br />W AND <br />k-.. <br />~ ~.~~ <br />M~O'sG~'~?O?pp6 <br />s~ °~a <br />IN THE MATTER OF COLORADO QUARRIES, INC.'S REQUEST FOR AN <br />EXTENSION TO ALLOW MORE TIME TO CONVERT PERMIT AND COMPLY WITH <br />THE CONDITIONS OF A PRIOR BOARD ORDER, FILE NUMBER M-1987-027 <br />THIS MATTER came before the Mined Land Reclamation Board ("Boazd") on <br />October 18, 2006 in Denver, Colorado for a hearing to consider a request for an extension <br />allow additional time to convert a permit from a Section 110 permit into a Section 112 <br />permit, as required by a prior Board order in this matter. The file number in this matter is <br />M-1987-027. Bill Tezak appeazed by telephone on behalf of Colorado Quarries, Inc. <br />("Operator"). Bob Oswald appeared by telephone on behalf of the Division of Reclamation, <br />Mining and Safety ("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />The Operator currently possesses an approved Section 110c Reclamation Permit fora 6- <br />acre rhyolite mine located in Section 8, Township 22 South, Range 72 West, 6`h P.M., <br />Custer County, Colorado. <br />2. The Division inspected the site on August 24, 2005 and observed approximately 2.03 acres <br />of mining activity outside the approved permit boundaries. The activity included topsoil <br />stripping, stockpiling, material excavation and hauling. <br />3. On Februazy 16, 2006, the Board held a duly noticed public hearing to consider the <br />Division's request to find the Operator in violation of the Colorado Land Reclamation Act <br />Colorado Quames, Inc.
