No.: 3-FITTS.02-13442-3 <br />Dear Mr. McGehee: <br />As you may recall from my letter to you of February 28, 1997 this office represents the <br />Fitts Family Trust, whose property the above-referenced easement benefits. <br />On May 28, 1997 your company sent Charlene Lane, the Fitts' daughter, a new consent <br />form for use by United Mining with regard to Permit No. M-88-037, Revision No. AM-1 , <br />which is pending with the Colorado Department of National Resources, Division of Mines and <br />Geology. Mrs. Lane has referred that letter to me. <br />When this matter first came [o me, the Fitts' had requested as a condition of signing the <br />requested consent, the reinstatement of the current North South (more or less) easement after <br />the reclamation of the open pit mine extension. However, they will now agree not to require <br />reinstatement of that easement as part of an agreement to waive it now. II is my understanding <br />that there is now an agreement in principal for the Fitts Trust to permanently give up the North <br />South easement, at least the portion North of the property line of the Skeltons' Montrose County <br />property. However, before that agreement can be finalized, and consent actually given, several <br />details between the Fitts', United, and the Skeltons need to be determined. In no particular <br />order, those are: <br />1. The Fitts want the portion of the easement which goes roughly westerly from the <br />existing easement along the North Boundary of the Southwest quarter of Section 13, Township <br />45 N, Range 13 West, NMPM to approximately 70 feet South of the West quarter corner of said <br />section to be deeded to them in perpetuity, in exchange for a permanent release (Grant Deed) <br />to the portion of the old easement which crosses the South one-half of the Northwest quarter of <br />said section (ie. the Skeltons' property). <br />
