The <br />proposed pipeline is included as one of the components of the previously submitted Technical Revision <br />application (TR07-61) for the 6MN Mine Water Storage Reservoir, however, unanticipated permitting <br />delays relating to permitting of the reservoir through the Colorado Division of Water Resources -Dam <br />Safety Division, and urgent operational needs force us to take this interim step to meet our ongoing mine <br />operational water requirements. <br />Water from the 10-Right Mine Dewatering Well, which pumps accumulated mine inflows from a sump in <br />the sealed Eastern Mining District, is pumped to the surface by a 320 HP high-capacity submersible <br />pump, at a rate of approximately 700 gpm. The pump dischazge is currently transferred by a series of <br />surface and undergound pipelines to the Area 1 Pit in the TCC Mine Facilities Area for use in either coal <br />prepazation operations or for storage and subsequent use as a back-up source for the operational mine <br />water system. As part of the 6MN Facilities project, TCC will establish a new pipeline running <br />approximately 7,750 feet from the 10-Right Dewatering pipeline to the existing 6MN Million-Gallon <br />Tank. The pipeline will be constructed of 10-inch HDPE pipe, buried to a depth of approximately six <br />feet, with one sub-grade crossing (bored under) of Fish Creek. <br />In conjunction with this crossing, TCC requests approval of a waiver to the stream buffer zone protection <br />requirements (Rule 4.05.18) for temporary pipeline construction disturbance within the buffer zone. The <br />proposed temporary pipeline construction disturbance will not cause or contribute to violation of <br />applicable water quality standazds; adversely affect water quality or quantity, and will not involve any <br />temporary diversion activities. Because the crossing of Fish Creek will be below grade, with no surface <br />disturbance of the stream channel or any associated wetlands, a U.S. Anny Corps of Engineers (USAGE) <br />Permit is not required.
