<br />i <br />~~~ ~~~~~~~~~~~~~ ~~~ ~ II, <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF ) NOTICE OF VIOLATION <br />LEE DOUGHTY CLAY PIT) AND <br />CEASE AND DESI54' ORDER <br />TO: LEE DOUG(fTY, and all other persons presently owniny <br />or acquiring new or in the future an interest in the <br />LEE DOUGHTY CLAY PIT. <br />FINDINGS OF FACT <br />PURSUANT to the authority vested in the Mined Land Rec1a{na tio.~ Board <br />by CRS 1973, 34-32-123, as amended (1976 Session Laws, HB 1065) th~=_ Board <br />hereby makes the following findings of fact: <br />1. LEE DOUGHTY is operating a clay mining operation located in (part <br />of Section 12, T2S, R714l, of the 6th PM, west of Highway 93 and <br />north of Coal Czeek Road, Jefferson County, Colorado. <br />2. Clay mining operations are required to be permitted by the Board <br />pursuant to the terms of Article 32 of Title 39, CRS 2973, ae. <br />amended (1976 Session Laws, HB 1065). <br />3. The Mined Land Reclamation Board has not received an application <br />from LEE DOUGHTY for clay mining and reclamation as of f~ovemk~er <br />28, 1980. <br />4. LEE DOUGHTY has not obtained a permit For clay mining. <br />NOTICE OF VIOLATION <br />You are hereby notified that the facts stated above constitute a <br />violation of Section 109(7), Article 32, Title 34, CRS 1973, as amended. <br />This section provides in pertinent part: <br />An operator shall obtain a development and extraction permit from <br />the Board for each mining operation. <br />(CONT'D) <br /> <br />I. <br />
