Long Division Director Pursuant to Title 33, Article 34, Paragraph 3, of the Colorado Revised Statutes, the Division of Minerals and Geology hereby issues notice that on February 22, 1993, an application for renewal of a valid, existing permit to conduct coal mining operations by Terror Creek Co., 1840 Highway 133, Paonia, Colorado 81428, was deemed complete for the purposes of filing. All reviews and comment periods as provided in the Act and Regulations promulgated thereunder initiate from this day of filing. The applicant proposes to continue conducting coal mining operations at the Terror Creek Loadout. The permit area is located in the following sections: Township 13 South, Range 91 West, 6th P.M. Section 15: E 1/2 NE 1/4 SW 1/4 south of State Highway 133 and the NE 1/4 SE 1/4 north of the railroad and south of State Highway 133 in Delta County. The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Bowie, Colorado. In order for us to approve this renewal application, we are required to affirm that the original finding that "the activities would not affect the continued existence of endangered or threatened species or result in the destruction or adverse modification of their critical habitats as determined under the Endangered Species Act of 1973..." remains valid. We request your review and recommendation pursuant to this finding, as well as your evaluation of the continued validity of the projections and assumptions of the mining and reclamation plan which relate to federally protected wildlife species. Applicable sections of the permit application are enclosed. Please advise us if you require additional information. In order for us to comply with regulatory time frames, we request that comments be submitted to the Division of Minerals and Geology at the above address by 5:00 p.m. on April 30, 1993. If no comments are received by this date, we will proceed on the assumption that your agency has no concerns with or objections to the applicant's proposal.
