Barra. <br />Drv~sion Director <br />RE: September 26, 1990, OSMRE Letter Regarding TDN No. 90-02-244-3, TV 3, <br />Peabody Coal Company, Nucla Mine, Permit No. C-81-008 <br />Dear Mr. Hagen: <br />• In response to your }otter referenced above, MLRD has inspected the outlet <br />of Culvert C-21 and the inlet to Sediment Pond 005, As noted in the <br />inspection report enclosed, Peabody has completed protection of the inlet <br />to Pond 005 in accordance with approved Minor Revision No. 12. Therefore, <br />a violation does not exist at the mine site, <br />We have not received a copy of the OSMRE inspection report for the August 16, <br />1990 inspection at Nucla.
