As previously discussed, and as contemplated in the Agreement <br /><IV, 3>, the roads leading to these pits must be configured to a <br />relatively maintenance free condition. This will include removal <br />of culverts, to be replaced by riprapped low water crossings, <br />and/or culvert designs which verify safe passage of the projected <br />10-year, 24-hour peak flows. Also, all existing culverts must be <br />maintained. <br />Pit 4 <br />l.) Please submit the plan to backslope the Pit 4 area above Pond 4. <br />Include pertinent pond designs if the slope reduction activities <br />will result in changes to Pond 4. Include bond calculations <br />including the estimated volume of material, for the work. <br />2.) Please submit topsoil redistribution depth information for Pit 4 as <br />previously discussed. <br />3.> Maintain all perimeter ditches and culverts to ensure that all <br />disturbed area drainage is routed to Pond 4. Check previous <br />inspection reports for details. <br />Pending Issues from the October 23, 1991 Letter <br />1.> Please respond to issue III.I. <br />2.) Issue IV.1 is changed as follows: <br />a. Hydrologic designs can be based upon the 10-year, 24-hour <br />peak flow, rather than the 100-year, 24-hour peak flow. <br />b. The post mining topography map issue is resolved as discussed <br />above. <br />c. As specified in the Agreement, some bond amount will be <br />retained, at the final increment release, if the Pits 5 and 6 <br />engineering work is not completed. <br />3.) Please respond to Issue IV. 2. Apparently some of the previously <br />agreed Pit 4 haul road slide mitigation work remains unfinished. <br />Some amount of bond money, designated for the Pit 4 road mitigation <br />work may be retained if all work is not complete. <br />At this time, the Division would like to have a commitment from Rockcastle <br />regarding implementation of the outstanding tasks. Please provide an <br />anticipated schedule for accomplishing work, and a schedule of forthcoming <br />bond release requests, including an estimate of the amount of money to be <br />released for each request. <br />Resolution of these issues will aid in expediting the pending bond release <br />request, and will help to ensure that the site is reclaimed in accordance with <br />the Agreement and the Regulations. <br />
